Four Hundred by Design Terms and Conditions

Please read the following terms and conditions before accessing, registering for, joining, or using Four Hundred by Design services, business model, and website.

The terms and conditions stated herein (collectively, the “Agreement”) constitute a legal agreement between you and Four Hundred by Design, LLC. (“the Company”). To use the Service, you must agree to the terms and conditions set forth below. By using or receiving any services supplied to you by the Company (collectively, the “Service”), and downloading, installing, or using any associated application or web service supplied by the Company, which purpose is to enable you to use the Service (collectively, the “Platform”), you hereby expressly acknowledge and agree to be bound by the terms and conditions of the Agreement, and any future amendments and additions to this Agreement as published from time to time on the Four Hundred by Design website.

The Company reserves the right to modify the terms and conditions of this Agreement or its policies relating to the Service at any time, effective upon posting of an updated version of this Agreement on the Service or Application. You are responsible for regularly reviewing this Agreement. Continued use of the Service or Application after any such changes, shall constitute your consent to such changes.

PAYMENT FOR SERVICES

You shall be responsible for registering on the Platform, providing necessary personal information (including, your full name, preferred email address, IATA number of your agency affiliation, and a preferred contact telephone number), payment authorizations for your client bookings – as well as for any services arranged as requested according to the terms and conditions of this Agreement – and any additional terms and conditions presented to you at the time of booking, which are incorporated herein by this reference. By registering with Four Hundred by Design, you agree to provide all requested information, including a credit card to be kept on file and used for pre-authorization of reservations for your clients, and payment for Services requested and authorized by you. When arranging a booking with a credit card, we may ask for written approval to use the credit card provided.

It is expressly understood that your client is and will always be, “your client” and that you will always be the “consultant of record” on any bookings we make for you on this Platform. There will be no effort on our part to market directly or indirectly to your clients, or contact them directly for any reason, other than pertaining to the ordinary communication that sometimes occurs between client and supplier. It will always be our preference to communicate with you first, and only contact your client directly if there is a time-sensitive issue that must be resolved, and we have been unable to reach you.

CONDUCT

If your conduct, or the conduct of your guests and clients, reflects negatively on the Company, or presents us in an inappropriate light, we may take measures, as we deem necessary, to prevent continuation of such conduct, up to and including permanent suspension of privileges for you and your client.

PRIVACY POLICY

Four Hundred by Design, LLC. (the “Company,” “Four Hundred by Design,” “FHxD” “we,” “our” or “us”) is committed to protecting your privacy and that of your clients. This Privacy Policy (this “Policy”) describes the types of information the Company may collect and how we may use that information to better serve you and your clients and to enhance the level of service offered by Four Hundred by Design (collectively, “Services”).

This Policy applies to information we collect:

  • Through the website.
  • Through the Platform.
  • Via phone calls.
  • In email, text, and other electronic messages between you and Four Hundred by Design.
  • Via any GDS.
  • Interactions with us via any third-party websites, applications, and services.

Please read this Policy carefully to understand our practices regarding your information and how we will treat it. This Policy may change from time to time.

PASSWORD AND ACCOUNT ACCESS

Consultant accepts that, by registering to create an account, consultant is responsible for any activity that occurs through said account. To prevent anyone from accessing the account in the consultant’s name, consultant should always maintain control over who has access to the account and under no circumstances reveal their password and any other login credentials to unauthorized users.

Consultant is responsible for updating and maintaining the accuracy of the information you provide to Four Hundred by Design relating to your account. To protect you, Four Hundred by Design reserves the right to terminate your account, or temporarily suspend your account, if we discover your login credentials are being used by an unauthorized user. If your site access shows “inactive” for more than twenty minutes, you will be logged out of the account, and will need to re-login to regain access.

SERVICES

In exchange for registering on our Platform, and booking reservations for you or your clients, Four Hundred by Design provides access to numerous travel services and benefits, including in most cases, enhanced revenue streams for the consultant and/or the consultant’s agency. Such services, benefits, and enhanced revenues are provided via an IATA accredited travel agency that can assist with reservations for the hotels, resorts, private homes, and villas on the Platform, (collectively, the “Services”). Four Hundred by Design reserves the right to add, change, suspend, or terminate any of the properties contained on the Platform, any Services, and any benefits at any time, including, without limitation, changes to terms and conditions associated with services or benefits.

ACCEPTANCE OF TERMS

Consultant or registrant agrees to provide all information requested by Four Hundred by Design through the Platform, via email, or regular mail, and telephone call, in accordance with Four Hundred by Design policies and procedures. Acceptance of consultants into the Platform is at the sole discretion of Four Hundred by Design.

TERM

Unless otherwise specified the term of your registration with the Four Hundred by Design Platform is in perpetuity, commencing on the day of the registration (the “Effective Date”). This does not, however, preclude your right to sever ties with Four Hundred by Design. If you wish to withdraw from this Platform and forgo any further communications with the Company, you must let us know in writing and we will suspend all services within 15 days from receipt of such communication. Four Hundred by Design reserves the right to terminate and cancel consultant’s registration at any time and for any reason, including if consultant breaches any terms or conditions of this Agreement or other agreements incorporated herein by reference. Consultant understands and agrees that if the registration is cancelled due to consultant’s breach of any terms or conditions of this Agreement or other agreements incorporated herein by reference, consultant will lose all privileges, and forfeit any additional benefits that might be available to consultant. Four Hundred by Design will not owe any further obligation to provide any Services, credits, or benefits to consultant, other than for any monies owed for services rendered on the Platform. Except as expressly provided herein, Consultant agrees that he or she will hold Four Hundred harmless for the loss of the Service, credits, or any additional benefits.

What personal data we collect and why we collect it

Comments

When visitors leave comments on the site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection.

An anonymized string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service privacy policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

Media

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you leave a comment on our site you may opt-in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

Who we share your data with

If you request a password reset, your IP address will be included in the reset email.

How long we retain your data
If you leave a comment, the comment and its metadata are retained indefinitely. This is so we can recognize and approve any follow-up comments automatically instead of holding them in a moderation queue.

For users that register on our website (if any), we also store the personal information they provide in their user profile. All users can see, edit, or delete their personal information at any time (except they cannot change their username). Website administrators can also see and edit that information.

What rights you have over your data
If you have an account on this site, or have left comments, you can request to receive an exported file of the personal data we hold about you, including any data you have provided to us. You can also request that we erase any personal data we hold about you. This does not include any data we are obliged to keep for administrative, legal, or security purposes.
